Terms of Service

These Terms of Service ("Terms") govern your use of WaiverTap (the "Service"), operated by [Company legal name], [address] ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you use the Service for a business, you confirm that you can bind that business.

1. The Service

WaiverTap lets businesses ("Customers") create forms such as liability waivers and consent forms, collect electronic signatures from their own customers ("Signers"), and store the signed records. We provide software only.

2. No legal advice

Templates, examples, and AI-generated drafts are provided for convenience. They are not legal advice and may not be enforceable in your location. You are responsible for the content of your forms and for having them reviewed by a qualified lawyer. We do not guarantee that any waiver or signature will be enforceable.

3. Your account

• Keep your login details secure. You are responsible for activity in your account.
• Give accurate information and keep it current.
• You must be at least 18 years old to create an account.

4. Your responsibilities toward Signers

You are the controller of the personal data you collect from Signers. You are responsible for having a lawful basis to collect it, for any notices or consents your local law requires, for the retention period of your records, and for responding to Signers' requests about their data. We process that data on your behalf as described in our Privacy Policy.

5. Acceptable use

You must not use the Service to break the law, collect data you are not allowed to collect, send spam, upload malicious code, interfere with the Service, or try to access data of other Customers.

6. Plans, fees, and cancellation

• Paid plans are billed in advance, monthly or yearly, through our payment provider (Stripe).
• Fees are non-refundable except where the law requires otherwise or we state otherwise in writing.
• You can cancel at any time. Your paid plan stays active until the end of the current period, then your workspace moves to the Free plan.
• "Unlimited" signed waivers on paid plans are subject to fair use. We may contact you about a custom plan if your use is far above typical levels.
• We may change prices with at least 30 days' notice. Changes apply from your next billing period.

7. Your data

You own the content and records you store in the Service. You can export them (CSV on paid plans, PDF on all plans) and delete them at any time. When you delete your workspace, its data is deleted from our active systems; backups expire on their normal schedule.

8. Availability

We work to keep the Service available, but it is provided "as is" and "as available". We do not promise uninterrupted service. Keep your own exports of important records.

9. Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

We may suspend or end accounts that break these Terms, with notice where reasonable. You may stop using the Service at any time.

11. Changes

We may update these Terms. We will notify you of material changes by email or in the app. Continued use after the effective date means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of [State/Country]. Disputes are handled in the courts of [County, State], unless your local consumer law requires otherwise.
